Terms of Sale.

1. Wholesale Buyers Only
Buyer represents it is a business purchasing for resale or professional culinary use. Retail and individual-consumer sales are not supported.
2. Intended Use Restriction
Products are sold exclusively as food-grade propellant for culinary applications. Buyer agrees not to market, package, or resell them in ways that encourage or facilitate inhalation or recreational use.
3. Downstream Compliance
Buyer agrees not to resell to any party buyer has reason to believe will misuse the product or sell into prohibited channels.
4. Regulatory Responsibility
Buyer is solely responsible for compliance with all applicable federal, state, and local laws in the jurisdictions where it operates or resells. See our Compliance page for current state-restriction summaries.
5. Verification
Buyer authorizes Space Gas to verify business identity, resale authority, and credit as needed. False information is grounds for immediate account termination.
6. Account Termination
Space Gas may terminate accounts or refuse orders at any time, including for suspected misuse, resale to prohibited channels, regulatory concerns, or non-payment.
7. No Medical Claims
Space Gas products are not intended to diagnose, treat, cure, or prevent any disease; not FDA-approved for medical use.
8. Indemnification
Buyer indemnifies Space Gas against claims arising from buyer's resale, use, or misuse of the products.
9. Payment & Freight
Unless otherwise agreed in writing, orders are invoiced at time of shipment with payment terms stated on the invoice. Freight is quoted per shipment and passed through at cost plus documented handling. Hazmat surcharges apply per carrier tariff.
10. Shipping & Risk of Loss
Title and risk of loss transfer to buyer upon pickup by carrier. Damage claims must be noted on delivery receipt and reported within 48 hours.
11. Returns
Sealed, unused tanks in original condition may be returned within 30 days with RMA authorization; buyer pays return freight. Used or damaged tanks are non-returnable.
12. Governing Law
